These Terms and Conditions outline the rules and regulations for use of atinypixel Labs's services, located at atinypixel.com.

Introduction

Welcome to atinypixel Labs. By accessing or using our website, services, and products, you agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our services.

Scope of Services

atinypixel Labs provides full-stack web and mobile development services, specialising in but not limited to the healthcare industry. The specifics of any project, including deliverables, scope, and deadlines, will be agreed upon in a separate contractual agreement.

Payment Terms

All projects require the following payment structure before and during work.

  • A 30% upfront payment is required before work commences.
  • The remaining payment schedule will be determined mutually (milestone-based, monthly, or full payment upon completion).
  • Late payments beyond 7 days will incur a 5% late fee per month.

Revisions & Change Requests

Our revision policy ensures clarity and prevents scope creep on both sides.

  • Clients are entitled to 2 rounds of revisions, each requiring a 5-day turnaround from their end.
  • Additional revisions or scope modifications will be charged separately based on an agreed hourly or fixed rate.

Intellectual Property

Ownership of deliverables is transferred to the client upon full payment, with one exception noted below.

  • Ownership of the final deliverables will be transferred to the client upon full payment.
  • atinypixel Labs reserves the right to showcase the completed work in its portfolio unless otherwise agreed.

Confidentiality & Security

We take confidentiality seriously and expect the same from our clients across all project engagements.

  • Both parties agree to maintain confidentiality concerning proprietary or sensitive information.
  • Any data shared must comply with applicable security and privacy regulations (e.g., HIPAA for healthcare projects).

Project Timelines & Client Responsibilities

Delivery schedules are agreed upfront and depend on timely cooperation from both parties.

  • Project timelines will be mutually agreed upon.
  • Delays caused by the client, such as late feedback or missing assets, may extend delivery schedules.

Warranty & Liability

We stand behind our work with a defined warranty period and clear liability terms.

  • We offer a 30-day warranty post-completion for bug fixes and performance issues arising from development errors.
  • The warranty excludes issues caused by third-party services, client-side modifications, or misuse.
  • atinypixel Labs is not liable for indirect damages, such as business losses, due to delays or service failures.

Termination Policy

Either party may exit the engagement with appropriate notice and settlement of outstanding work.

  • Either party may terminate the contract with a 30-day written notice.
  • The client must pay for all work completed up to the termination date.
  • The 30% upfront payment is non-refundable.

Kill Fee & Project Cancellation

All kill fees are calculated as a percentage of the total agreed contract value. The 30% upfront deposit counts toward the applicable kill fee — not in addition to it. If a kill fee tier is less than the deposit already paid, no refund is issued on the difference.

No work commenced; upfront deposit refundable less any directly incurred expenses.

After 2 weeks

Project under 25% complete. The 30% deposit already covers this tier — no additional charge.

25%

At 50% completion

Midway through delivery — 30% additional is due beyond the upfront deposit.

60%

At 80% completion

Near completion — 60% additional is due beyond the upfront deposit.

90%

On or before delivery

Final deliverables ready or handed over — full contract value is owed.

100%

Example — On a ₹1,00,000 contract cancelled at 50% completion, ₹60,000 total is owed. Since ₹30,000 (upfront) is already paid, only ₹30,000 additional is due.

Compliance & Legal Regulations

We build to industry standards, and expect clients to own their specific regulatory compliance requirements unless explicitly scoped.

  • atinypixel Labs adheres to industry standards such as GDPR, HIPAA, and PCI-DSS, where applicable.
  • Compliance with specific regulations remains the client's responsibility unless explicitly included in the agreement.

Support & Maintenance

Ongoing support is a separate engagement from the initial project delivery and must be contracted independently.

  • Support and maintenance services are not included unless a separate agreement is signed.
  • Clients may opt for ongoing maintenance and security updates under a paid service plan.

Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of India. Any disputes shall be resolved through mutual arbitration before pursuing legal action.
